Bodily harm or physical impairment must be shown by the plaintiff. This usually means furnishing proof that asbestos was the leading contributor (rather than other factors such as long-term smoking) to their asbestosis, and that asbestos was the direct cause of their asbestosis. Typically, the following types of proof of injury concerning asbestosis will be sufficient: 1) A chest x-ray corroborating the presence of asbestosis that satisfies or exceeds the prescribed range and 2) the opinion of a board-certified pathologist that the patient's respiratory impairment has attained a certain level and that he or she has a certain scarring pattern.
